How to Buy an Apartment in Bulgaria

The process of buying an apartment

A typical apartment purchase in Bulgaria involves the following stages:

  • Selecting the property;
  • Independent legal and technical checks;
  • Signing a written reservation agreement, if used;
  • Negotiating and signing the preliminary contract;
  • Signing the notarised deed and recording it in the Property Register;
  • Completing any applicable post-purchase registrations and account changes.

Each transaction differs, but the main checks are outlined below.

Selecting the property

A viewing trip can help you compare shortlisted apartments. Record the exact address, unit, condition, quoted area, annual fees and what is included in the price. Ask for written answers about payment terms, construction status and local infrastructure before choosing an apartment in Bulgaria.

Legal due diligence

No listing or agency statement replaces independent legal checks. A Bulgarian lawyer acting for the buyer should review the seller's title, authority to sell, Property Register entries, cadastral data and relevant construction documents, including Acts 14, 15 or the commissioning document where applicable.

  • registered mortgages, attachments or other encumbrances;
  • unpaid obligations, disputes or third-party claims that could affect the transaction.

The lawyer should also check the land rights and building documents. Area figures in Bulgarian listings may include wall thicknesses and a share of common areas, so distinguish the unit's net or built-up area from the total saleable area.

Reservation agreement

A reservation payment may be requested after a property is selected. The amount varies. Before paying, require a signed agreement that identifies the property, price, recipient, reservation period, due-diligence conditions and refund rules.

Do not assume that every reservation payment is non-refundable or transferable. The contract must state what happens if legal checks fail, the seller withdraws, finance is refused or the buyer changes plans.

Preliminary contract

The preliminary sale agreement should record the parties, exact property, price, payment schedule, completion deadline, documents required, default remedies and refund rights. If it is bilingual, specify which version controls and use an independent translator or lawyer; translation alone does not prevent disputes.

Important Before signing, check every name, identifier, property detail, payment instruction, deadline and condition. Do not accept blank fields or verbal promises outside the contract.

Notarial deed and completion

At completion, the deed is signed before the competent Bulgarian notary, personally or through a valid representative. Payment and document arrangements should be agreed and independently verified in advance. The deed is then submitted for entry in the Property Register, completing the legal transfer of property in Bulgaria . Ownership should be confirmed through the registered deed and an up-to-date official record, not through an agency assurance alone.

Post-completion steps
